22-year-old law student and social media personality Sharmistha Panoli was apprehended from her residence in Gurugram by Kolkata Police in connection with a contentious Instagram video. The video, which was connected to “Operation Sindoor,” purportedly included communal comments for which legal action was taken on serious IPC sections. While debates on free speech, online accountability, and police excess gather momentum, this case also raises crucial questions on the boundaries of expression in today’s digital era.
Date of Arrest: May 30, 2025
Location: Gurugram, Haryana
Arrested By: Kolkata Police
Allegation: Sharing communal and inflammatory comments on Instagram
Sharmistha Panoli is a law student of 22 years from Pune and an influential social media content creator. Popular among her viewers for her cutting remarks on contemporary affairs, she regularly puts out videos on legal, political, and cultural issues. Her views have earned her a significant number of followers on Instagram and elsewhere.
But then, in May 2025, one of her videos got her into serious legal hot water.
Sharmistha Panoli made a derogatory comment on a now-deleted Instagram video against leading Bollywood celebrities for their failure to comment on “Operation Sindoor,” a police operation introduced by the Kolkata Police for curbing organized crime and illegal activity.
What prompted legal action was not her denunciation of celebrities, but some comments within the video said to be communal in nature. The material was regarded as encouraging religious discord and even inciting discord, the Kolkata Police said.
After public outcry, Sharmistha removed the video and offered an apology. However, by that time, a First Information Report (FIR) had already been registered and authorities asserted she and her family members had turned themselves untraceable. That resulted in an arrest warrant being issued.
On May 30, a Kolkata Police team arrested Panoli from her home in Gurugram, Haryana. She was produced in transit remand in Kolkata. She now stands accused legally for reportedly offending sections of the Indian Penal Code, specifically:
Section 153A – Inciting animosity between various groups on religious, racial, etc., grounds.
Section 295A – Intentional and malicious acts meant to cause outrage to religious feelings
Other sections related to public mischief and incitement
Operation Sindoor is an anti-crime campaign launched by Kolkata Police to eliminate organized criminal networks operating in and around the city. It has received significant media attention and is regarded as a major law enforcement move in West Bengal.
Sharmistha Panolis video allegedly linked this operation to communal issues, questioning why certain public figures remained silent, which sparked the controversy.
The arrest has also led to a furious online discussion. While some people and activists denounced the arrest as a repression of freedom of speech, others endorsed the police action, stating that public figures in particular—also influencers—ought to act responsibly.
The hashtag #ReleaseSharmistha started trending, and many used Article 19(1)(a) of the Indian Constitution, which ensures the freedom of speech and expression
However, this right is not absolute. It is subject to reasonable restrictions to maintain public order, decency, and morality. Courts have previously ruled that speech inciting violence, hatred, or communal tensions can justifiably be restricted.
Sharmistha Panoli’s case highlights the thin line between exercising one’s right to speak freely and the legal limits of online expression, especially in a sensitive, diverse society like India.
Influencers have the power over great numbers. Their voice can educate, motivate—or enrage. Legal professionals point out that while freedom of speech is critical in every democracy, it should be practiced with restraint, particularly on a medium as influential and quickly spreading as social media.
Sharmistha Panoli is currently in Kolkata and under formal investigation. Her lawyers are said to be filing a bail application and will possibly dispute the charges in court. The case’s determination may have a major bearing on the regulation of digital speech in India.
The arrest of Sharmistha Panoli is not merely a legal moment—it’s a reflection of our times. In an era where social media is a main avenue for public opinion, the case reminds us that freedom is not without responsibilit
